Termini d'uso

I presenti Termini d'uso ("Termini") regolano l'utilizzo dell'applicazione mobile Eyenima ("App") sviluppata e distribuita da Totem Consulting ("Titolare"). Scaricando, installando o utilizzando l'App accetti integralmente questi Termini. Se non accetti, non utilizzare l'App.

⚠️ Avviso importante: Eyenima è un'applicazione di benessere educativa. Non è un dispositivo medico, non è approvata da alcuna autorità regolatoria, non fornisce diagnosi né raccomandazioni terapeutiche e non sostituisce in alcun modo una visita con un oculista o un optometrista qualificato.

1. Oggetto del servizio

Eyenima fornisce, a scopo puramente educativo, ricreativo e di benessere personale:

Una suite di test visivi sperimentali (acuità, sensibilità al contrasto, near-point convergence, distanza interpupillare, tempo di reazione, ecc.).
Una funzione di fotografia biometrica artistica dell'iride ("Iris Art") che cattura la texture dell'iride e ne genera ritratti creativi.
Una galleria locale per consultare e esportare le proprie sessioni e immagini.

2. Esclusione di finalità mediche

Eyenima non è un dispositivo medico ai sensi del Regolamento (UE) 2017/745 sui dispositivi medici (MDR), né un Software as a Medical Device (SaMD). I risultati dell'App:

Hanno valore puramente indicativo e educativo.
Non costituiscono diagnosi, prognosi, screening clinico né raccomandazione terapeutica.
Non possono e non devono essere utilizzati per prevenzione, diagnosi, monitoraggio o trattamento di patologie.
Non sostituiscono il giudizio di un professionista sanitario qualificato.

Se hai dubbi sulla tua vista o noti variazioni persistenti, rivolgiti sempre a un oculista o optometrista qualificato.

3. Limiti di accuratezza

L'accuratezza dei test offerti da Eyenima dipende da fattori non controllabili dall'App: condizioni di illuminazione ambientale, distanza dal volto, stabilità del dispositivo, calibrazione dello schermo, modello di iPhone, presenza di occhiali o lenti a contatto. I risultati non sono certificati e possono variare significativamente tra sessioni.

4. Uso responsabile

L'utente si impegna a utilizzare Eyenima in condizioni di sicurezza. È vietato utilizzare l'App mentre si guida un veicolo, si operano macchinari, si attraversa la strada o si svolge qualsiasi altra attività che richieda piena attenzione. Alcuni test (es. PVT, near-point convergence) possono temporaneamente affaticare la vista: interrompere l'uso in caso di affaticamento o disagio.

5. Età minima

L'utente dichiara di avere almeno 18 anni. La funzione galleria pubblica richiede esplicitamente conferma di maggiore età.

6. Trattamento dei dati biometrici

L'utilizzo di Eyenima implica il trattamento di dati biometrici (immagini iride, misurazioni pupillari) ai sensi dell'art. 9 GDPR, sulla base del consenso esplicito prestato al primo avvio. Tutti i dati restano esclusivamente sul dispositivo dell'utente e non vengono trasmessi. Per i dettagli consulta la Privacy Policy.

7. Acquisti in-app (Tip Jar)

L'App offre la possibilità di lasciare mance volontarie (tip) tramite Apple In-App Purchase. Le mance sono acquisti consumable, gestiti interamente da Apple, e non sbloccano alcuna funzionalità aggiuntiva: sono donazioni volontarie a sostegno dello sviluppo. Non ci sono abbonamenti né rinnovi automatici. Il rimborso segue le politiche standard di Apple App Store.

8. Proprietà intellettuale

Tutti i diritti di proprietà intellettuale sull'App, sui suoi contenuti, sulla grafica, sui marchi e sui codici sorgente appartengono a Totem Consulting e ai rispettivi titolari. Le immagini Iris Art generate localmente dall'utente con l'App restano di proprietà dell'utente, che ne è libero di disporre.

9. Limitazione di responsabilità

Nei limiti consentiti dalla legge applicabile, Totem Consulting non è responsabile per:

Decisioni sanitarie, mediche o terapeutiche prese dall'utente sulla base, anche solo parziale, dei risultati mostrati dall'App.
Conseguenze derivanti dall'uso improprio dell'App (es. uso durante la guida, in condizioni inadeguate, ecc.).
Perdita di dati locali dovuta a malfunzionamento del dispositivo, disinstallazione, aggiornamenti del sistema operativo.
Interruzioni temporanee del servizio di Apple App Store o degli acquisti in-app.

10. Modifiche dell'App e dei Termini

Totem Consulting si riserva il diritto di modificare in qualunque momento l'App e i presenti Termini, con effetto dalla pubblicazione delle nuove versioni. L'uso continuato dell'App dopo le modifiche costituisce accettazione delle stesse.

11. Apple EULA

L'utilizzo dell'App è inoltre soggetto allo Standard Apple End User License Agreement, disponibile all'indirizzo apple.com/legal/internet-services/itunes/dev/stdeula/.

12. Foro competente e legge applicabile

I presenti Termini sono regolati dalla legge italiana. Per qualunque controversia il foro competente è quello del consumatore quando applicabile, altrimenti il foro di Milano (Italia).

Terms of Use

These Terms of Use ("Terms") govern the use of the mobile application Eyenima ("App") developed and distributed by Totem Consulting ("Provider"). By downloading, installing or using the App you fully accept these Terms. If you do not accept them, do not use the App.

⚠️ Important notice: Eyenima is an educational wellness application. It is not a medical device, has not been cleared by any regulatory authority, does not provide medical diagnosis or treatment recommendations, and does not replace a visit with a qualified eye-care professional.

1. Subject of the service

For purely educational, recreational and personal-wellness purposes, Eyenima provides:

A suite of experimental visual tests (acuity, contrast sensitivity, near-point convergence, interpupillary distance, reaction time, etc.).
An artistic iris photography feature ("Iris Art") that captures the iris texture and generates creative portraits.
A local gallery to review and export the user's own sessions and images.

2. Exclusion of medical purpose

Eyenima is not a medical device under Regulation (EU) 2017/745 on medical devices (MDR), nor a Software as a Medical Device (SaMD). Results from the App:

Are indicative and educational only.
Do not constitute diagnosis, prognosis, clinical screening or therapeutic recommendation.
Cannot and must not be used for the prevention, diagnosis, monitoring or treatment of any condition.
Do not replace the judgment of a qualified healthcare professional.

If you have any concerns about your vision or notice persistent changes, always consult a qualified eye-care professional.

3. Accuracy limits

The accuracy of Eyenima's tests depends on factors outside the App's control: ambient lighting, distance from the face, device stability, screen calibration, iPhone model, eyewear or contact lenses. Results are not certified and may vary significantly between sessions.

4. Responsible use

The user agrees to use Eyenima in safe conditions. It is forbidden to use the App while driving a vehicle, operating machinery, crossing the street, or performing any other activity that requires full attention. Some tests (e.g., PVT, near-point convergence) can momentarily fatigue the eyes: stop using the App in case of fatigue or discomfort.

5. Minimum age

The user declares to be at least 18 years old. The public gallery feature explicitly requires confirmation of legal age.

6. Biometric data processing

Use of Eyenima implies processing of biometric data (iris images, pupillary measurements) under GDPR article 9, on the basis of explicit consent provided at first launch. All data remains exclusively on the user's device and is not transmitted. For details, see the Privacy Policy.

7. In-App Purchases (Tip Jar)

The App offers the option to leave voluntary tips via Apple In-App Purchase. Tips are consumable purchases, fully managed by Apple, and do not unlock any additional feature: they are voluntary donations supporting development. There are no subscriptions or auto-renewals. Refunds follow the standard Apple App Store policies.

8. Intellectual property

All intellectual property rights to the App, its contents, graphics, trademarks and source code belong to Totem Consulting and the respective owners. Iris Art images generated locally by the user with the App remain the property of the user, who is free to dispose of them.

9. Limitation of liability

Within the limits of applicable law, Totem Consulting shall not be liable for:

Health, medical or therapeutic decisions taken by the user on the basis, even partial, of the results displayed by the App.
Consequences arising from improper use of the App (e.g., use while driving, in inadequate conditions, etc.).
Loss of local data due to device malfunction, uninstallation, or operating-system updates.
Temporary interruptions of Apple App Store or in-app purchase services.

10. Modifications to the App and Terms

Totem Consulting reserves the right to modify the App and these Terms at any time, with effect from publication of the new versions. Continued use of the App after modifications constitutes acceptance.

11. Apple EULA

Use of the App is also subject to the Standard Apple End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula/.

12. Governing law and jurisdiction

These Terms are governed by Italian law. For any dispute the competent jurisdiction is the consumer's forum where applicable, otherwise the courts of Milan (Italy).
